This undertaking is made subject to the condition that those who seek licences agree to reciprocate the same in respect of the STANDARD in accordance with Clause 6.1 of the ETSI IPR Policy.

Furthermore, Motorola has stated the following:
"For the avoidance of doubt, and in accordance with Motorola’s recent correspondence to ETSI, Motorola reaffirms its longstanding position that it has undertaken no obligation in connection with the TETRA standards (including TETRA I and TETRA 2) to license its Essential TETRA patents worldwide, and hereby specifically acknowledges the exclusion of North America from its licensing undertaking.

Motorola continues to support full disclosure and transparency, and is therefore voluntarily listing the patent family information as requested on this form. Motorola notes that providing this patent family information is optional, and specifically reserves its rights to submit an independent licensing undertaking statement either in free form or via the IS & LD forms."
