The SIGNATORY has notified ETSI that it is the proprietor of the IPRs listed above and has informed ETSI that it believes that the IPRs may be considered ESSENTIAL to the GSM standard.
The SIGNATORY and/or its AFFILIATES hereby declare that they are prepared to grant irrevocable licences under these IPRs on terms and conditions which are iin accordance with Clause 6.1 of the ETSI Interim IPR Policy, in respect of the GSM standard, to the extent that the IPRs are and remain ESSENTIAL.
The construction, validity and performance of this DECLARATION shall be governed by the laws of France.
The Nokia proposal for Enhanced Full Rate (EFR) speech codec for GSM standard is a result of cooperation between Nokia, Université de Sherbrooke (USH) and Siprolab Telecom Inc.
USH own the Canadian priority patent application 010,830 and all counterparts of rights derived thereof. Nokia owns the patent application GB 9511284.
Nokia has the exclusive right to license any patents owned by USH or Siprolab which are essential to the implementation of the EFR codec for the GSM Standard.
